Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Coloria application (the "Service") operated by Coloria ("us", "we", or "our").

1. Acceptance of Terms

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

2. Merchants of Record

Your order process and contract will be handled by the respective reseller based on your point of purchase:

  • Apple Inc.: For purchases made through the Mac App Store. Apple is the Merchant of Record, and its terms and conditions apply to those transactions.
  • Paddle.com: For purchases made directly through our official website. Paddle.com is the Merchant of Record for these orders.

3. Subscriptions & Billing

Coloria offers professional features on a subscription basis. By subscribing, you agree to the following:

  • Billing Cycle: You will be billed in advance on a recurring and periodic basis (monthly or annually).
  • Free Trial: We offer a 7-day free trial. You will not be charged until the trial expires. Unless cancelled, the applicable subscription fee will be automatically charged on the last day of the trial.
  • Cancellation:
    • App Store Purchases: You can manage or cancel your subscription at any time through your Apple ID Account Settings.
    • Website Purchases: You may cancel via the "Manage Subscription" page in the application or by contacting Paddle support.

4. Refunds

Refund policies vary depending on the Merchant of Record:

  • App Store Purchases: All refunds for App Store purchases are handled exclusively by Apple. To request a refund, please follow the instructions on Apple’s official support page (https://reportaproblem.apple.com).
  • Website Purchases (Paddle): Refund requests are generally honored if made within 14 days of the initial transaction. To request a refund for a website purchase, please contact our support team at support@coloria.me or reach out to Paddle Support.

5. License & Use

Coloria grants you a limited, non-exclusive, non-transferable license to use the Application on macOS devices you own. You may not:

  • Reverse engineer or attempt to extract the source code of the Application.
  • Use the Service for any illegal or unauthorized purpose.
  • Sublicense, rent, or lease the Application to third parties.

6. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Coloria. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

7. Limitation of Liability

Coloria is provided "AS IS" and "AS AVAILABLE". In no event shall Coloria be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service.

8. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 30 days' notice for material changes. By continuing to use Coloria after revisions become effective, you agree to be bound by the updated Terms.

10. Apple App Store Provisions

The following terms apply to users who downloaded Coloria from the Apple Mac App Store:

  • Acknowledgement: These Terms are between you and Coloria only, not with Apple. Apple is not responsible for the App or its content.
  • Maintenance: Coloria is solely responsible for providing any maintenance and support services. Apple has no obligation to furnish any maintenance and support services.
  • Warranty: Apple is not responsible for any product warranties. In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price.
  • Third Party Beneficiary: Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you.
